Article 1 – Definitions

The following definitions apply to these terms:

  • Cooling-off Period: The period within which the consumer may exercise their right of withdrawal.

  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a remote agreement with the Entrepreneur.

  • Day: Calendar day.

  • Continuing Performance Transaction: A remote agreement relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.

  • Durable Data Medium: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows for future consultation and unchanged reproduction of the stored information.

  • Right of Withdrawal: The option for the consumer to cancel the remote agreement within the cooling-off period.

  • Entrepreneur: The natural or legal person offering products and/or services to consumers remotely.

  • Remote Agreement: An agreement concluded within the framework of a system organized by the entrepreneur for the remote sale of products and/or services, using exclusively one or more techniques for remote communication up to the conclusion of the agreement.

  • Technique for Remote Communication: A means that can be used to conclude an agreement without the consumer and entrepreneur being in the same room at the same time.

Article 2 – Applicability

These Terms & Conditions apply to every offer made by the entrepreneur and to every remote agreement and order concluded between the entrepreneur and the consumer. Before the remote agreement is concluded, the text of these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded that the terms can be viewed at the entrepreneur's location and will be sent free of charge as soon as possible upon request.

Article 3 – The Offer

If an offer has a limited duration or is subject to conditions, this will be explicitly stated. Offers are non-binding. The entrepreneur is entitled to change and adjust the offer. The offer contains a complete and accurate description of the products and/or services. Images are a true representation; however, manifest errors or mistakes do not bind the entrepreneur. Note: Prices exclude customs clearance fees and import VAT. These additional costs are the responsibility and risk of the customer.

Article 4 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the specified conditions. The entrepreneur will immediately confirm receipt of acceptance electronically.

Article 5 – Right of Withdrawal

Upon purchasing products, the consumer has the option to dissolve the agreement without giving reasons for 30 days. This period begins the day after receipt of the product. During this period, the consumer shall handle the product and packaging with care, only unpacking it to the extent necessary to decide whether to keep it.

Article 6 – Costs of Withdrawal

If the consumer exercises their right of withdrawal, the costs of returning the products are the responsibility of the consumer. The entrepreneur will refund the purchase amount as soon as possible, no later than 30 days after the return is received or proof of return is provided.

Article 7 – Exclusion of the Right of Withdrawal

The entrepreneur can exclude the right of withdrawal for specific products, such as:

  • Custom-made or personalized items.

  • Items that spoil quickly or have a limited shelf life.

  • Sealed hygienic products where the seal has been broken.

  • Unsealed audio/video recordings or software.

Article 8 – Pricing

Prices will not be increased during the offer period, except for changes in tax rates. Import Notice: For deliveries outside the EU (including the US), import VAT and/or customs fees may be collected by the courier. The entrepreneur does not charge VAT on these shipments.

Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products meet the specifications stated in the offer and reasonable requirements of reliability. Any defects must be reported in writing within 30 days of delivery.

Article 11 – Delivery and Execution

The company will take the greatest possible care when receiving and executing orders. The place of delivery is the address provided by the consumer. Orders will be executed within 30 days unless a longer period is agreed upon.

Article 12 – Continuing Transactions

The consumer may terminate an indefinite agreement at any time, subject to agreed-upon termination rules and a notice period of no more than one month.

Article 13 – Payment

Unless otherwise agreed, amounts owed by the consumer must be paid within 7 working days after the start of the cooling-off period. The consumer must report inaccuracies in payment data immediately.

Article 14 – Complaints Procedure

Complaints about the execution of the agreement must be submitted fully and clearly to the entrepreneur within 7 days after the consumer discovers the defects. Responses will be provided within 30 days.

Article 15 – Disputes

Agreements between the entrepreneur and the consumer to which these terms apply are governed exclusively by Dutch law, even if the consumer resides abroad.

Article 16 – CESOP

In accordance with measures introduced in 2024 regarding the implementation of the Central Electronic System of Payment Information (CESOP), payment service providers may record transaction data in the European CESOP system for tax compliance.
